1. Acceptance of Terms
By downloading, installing, or using the MyPeptide mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and MyPeptide, Inc. ("MyPeptide," "we," "us," or "our").
2. Description of Service
MyPeptide is a general wellness application that uses artificial intelligence to analyze user-provided health data and generate personalized wellness suggestions, including recommended peptide protocols. The App also provides dose tracking, protocol management, and integration with third-party wearable health platforms.
MyPeptide is not a medical device, healthcare provider, pharmacy, telehealth platform, or licensed medical service. We do not sell, dispense, or distribute peptides or any other substance.
3. Eligibility
You must be at least 18 years of age to use the App. By using the App, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. The App is not available to users under 18.
4. Accounts and Registration
You must create an account to use the App. You agree to provide accurate, current, and complete information and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use at support@mypeptide.app.
5. Subscriptions and Billing
Subscription plans
MyPeptide offers auto-renewable subscription plans:
- Monthly plan: $9.99 per month
- Annual plan: $54.99 per year ($4.58/month)
Billing
Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription at any time in your Apple ID Account Settings at Settings → [your name] → Subscriptions.
Price changes
We may change subscription prices at any time. We will notify you of price changes at least 30 days before they take effect. Continued use after the price change takes effect constitutes acceptance of the new price.
Refunds
All purchases are processed by Apple. Refund requests are subject to Apple's refund policy. Contact Apple Support at reportaproblem.apple.com to request a refund.
6. Free Trial
MyPeptide offers a 3-day free trial for new subscribers. The free trial is available to new subscribers only and one free trial per Apple ID. At the end of the free trial period, your subscription will automatically begin and payment will be charged to your Apple ID unless you cancel at least 24 hours before the trial ends.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the App or its infrastructure
- Reverse engineer, decompile, or disassemble the App
- Use the App to distribute malware or other harmful code
- Impersonate any person or entity
- Share your account credentials with any third party
- Use the App in any way that could damage, disable, or impair the App
- Use AI-generated wellness suggestions as a substitute for professional medical advice
8. Health and Medical Disclaimer
THE APP DOES NOT PROVIDE MEDICAL ADVICE. All content, AI-generated suggestions, protocol recommendations, dosing information, and other information provided through the App are for informational and educational purposes only.
The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or before starting any new wellness protocol.
Never disregard professional medical advice or delay in seeking it because of something you have read or received through the App. MyPeptide makes no representations or warranties about the accuracy, completeness, or suitability of any wellness suggestion for your individual circumstances.
By using the App, you acknowledge and accept full responsibility for any decisions you make based on information provided by the App, including decisions related to the use of peptides or any other substance.
9. AI-Generated Content
The App uses artificial intelligence to generate personalized wellness suggestions. You acknowledge that:
- AI-generated suggestions are based on the data you provide and may not account for all individual health factors
- AI suggestions are not reviewed by a licensed healthcare provider before being presented to you
- The accuracy of suggestions depends on the accuracy and completeness of data you provide
- AI technology has limitations and may produce suggestions that are not appropriate for your individual situation
- All AI-generated suggestions should be reviewed with a qualified healthcare provider before implementation
10. Intellectual Property
The App and all content, features, and functionality — including but not limited to text, graphics, logos, software, and AI models — are owned by MyPeptide, Inc. and are protected by United States and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works from any part of the App without our express written permission.
11. Privacy
Your use of the App is also governed by our Privacy Policy, available at mypeptide.app/privacy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, MYPEPTIDE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY AI-GENERATED WELLNESS SUGGESTIONS.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYPEPTIDE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE APP OR ANY AI-GENERATED WELLNESS SUGGESTION.
IN NO EVENT SHALL MYPEPTIDE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO MYPEPTIDE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
14. Indemnification
You agree to indemnify, defend, and hold harmless MyPeptide, Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any decisions you make based on AI-generated wellness suggestions.
15. Termination
We may terminate or suspend your account and access to the App at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting the App and cancelling your subscription through your Apple ID Account Settings. Upon termination, your right to use the App ceases immediately.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the App shall be resolved by binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
17. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by email and in-app notice at least 30 days before the effective date. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.
